Stealth candidate nominates friend as stealth nominee to the U.S. Supreme Court

We vet presidential candidates for roughly two years now.  But since the press no longer does its job, Obamster got a free pass. We haven’t seen his long form birth certificate, any of  his grammar school records, his Occidental college records, his Columbia college records, his Harvard law transcripts.  Hell, we aren’t even sure that he wrote the two books that he supposedly wrote.  We know virtually nothing about him.  He could not even get hired as a lower level associate at a typical law firm without producing his transcripts.  We got nothing. 

His nomination of Elena Kagan is more of the same.  We do not know what she believes.  We do not know how she will rule.  We do know that she is “a friend” of Barack Zero Obama and that they both became lecturers in the Chicago School of Law in the same year.  We know that Obama is a radical.  I think it is safe to assume that his friends are likewise radicals until proven otherwise. 

The fact that some Republicans voted to support her nomination to the position of Solicitor General is of no import.  That job is a mere mouthpiece for the government and is not a life-long tenured position.  I do not consider the fact that she has no experience as a judge to be a negative.  Many justices in the past have not been judges before they were elevated to the bench. 

The most notorious in my book was Earl Warren, who was California District Attorney, Attorney General and then Governor before ascending to the position of Chief Justice of the United States Supreme Court.  But he also illustrates the problem with elevating someone to the Court who has no history of judging upon which to judge his credentials.  Everyone assumed that Warren would be a law and order type conservative, due to his prior career in law enforcement.   But he turned out to be the leader of one of the most liberal courts in United States history.

Obama himself is on record himself while a Senator as opposing conservative nominees solely upon their conservative positions.  I think that Republican Senators should treat his nominee the same way that Obama treated George Bush’s nominee.  Oppose Kagan for the simple reason that Obama opposed Bush’s nominee.  What’s good for the goose is good for the gander.

  1. Maybe the public at large needs to start “electing” the Supreme Court Justices. Put the likely candidates out there, conservative and liberal. Let them answer the same questions from the public that they would get from the Senate. Let the people decide who they want on the Supreme Court. It would still be a lifetime appointment.

    Or, give the likely candidates questions on the constitution only. We don’t need to know their personal opinions on anything else. When a person becomes a SCJ, they are supposed to leave their personal opinions and biases at the door and make their legal opinions based on the constitution as written.

    I know that’s an impossible scenario, but wouldn’t it be great if that’s the way it was?

  2. I’m not sure what the answer is, but i know the current system is broken. Democrats support her just because she is presumably liberal. Many Pubs will not object just because there is nothing concrete upon which to base an objection (although I think her calling the military’s “Don’t ask, don’t tell” policy “immoral” is grounds enough to disqualify her as either an idiot or an immoral moron).

  3. Earl Warren was, by Eisenhower’s own admission, the worst decision he made in his entire tenure as President. Another interesting note; “Ike” won the Presidency for two terms in ’52 and ’56 as a Republican, but when he lost in 1948, he had run as a Democrat.

    Eisenhower did some good things as President. We can thank him for our extensive interstate highway system.

    I would say, though, that #2 on the “worst” list, Ike not “censoring” McCarthy was a good move, but Ike should have paid more attention to what McCarthy was saying. A little more backbone by Ike may have set the socialist agenda back several decades at worst and demolished their pogram at best.

    We we know, instinctively, that evil lurks in the dark. This is how Obama ran, and how Kagan is pretty much “in the dark” as well. Perhaps not in the evil perspective but so much more is NOT known about her than the inverse.

    For the record, I think DADT is the wrong policy for the miliary too – but for different reasons than many. But DADT cannot be repealed until a suitable moral code in instituted across the military keeping everyone’s sexual agenda out of the work place. As a leader I had a far greater number of issue with hetero “pimps” than homosexual troops, but that does lead us too…

    Why both sides are really neervous about Elena – and that is her sexuality – more specifically her politics on sexuality. I have debated this issue lightly with Cynthia Yockley and Trey Givens and others who know the real poorly kept secret: Elena Kagan is a lesbian. And what makes many nervous, without stating such is that we may get – along with a throughly liberal Supreme Court judge, our first Supreme Court gay activist.

    Again, Kagan’s PERSONAL sexual preference doesn’t concern me. Appointing a life-long gay rights activist to our nations highest court does concern me. I am not sure that’s the right place for someone with that agenda to be sitting.

      Clerking for possibly the worst mistake – EVER – for the high court is not a resume-enhancer.

      And I DO have issue with a supreme court justice who has NEVER, EVER decided in case in ANY court. That’s IMHO more ignorant than someone with a resume of ONLY being a Jr. State Senator being elected President…

      Oh, yeah. We’ve seen what a disaster that’s been….

      Another Stupid Liberal Trick – trying to win an argument by invoking Rush.

      And, if you’ve looked recently, Rush is hardly fat. Get your facts straight Gramps….

      However, I again remind you of my point. I don’t care what plumbing Elena prefers in the privacy of her bedroom – although I did place a “betting man’s” wager on where she falls in that regard.

      With her appointment to the Supreme Court, I have concern who displays the possibility of bringing an activist agenda – of any sort – to the Supreme Court. I also believe the ranking judges in the land should have at least – been judges.

      I personally have measured Elena Kagan on both issues and found her wanting. And thus, my opinion. Which as always, YMMV…

      No reason to thank me Gramps, just applying the wisdom of experience.

      If it were a perfect world, no one would have cause to wonder who sleeps with whom. Some things do not belong in the public arena – and frankly, they didn’t used to. However…

      If you’re a guy and you’re gonna knobslobber in the barracks – you will get the attention your actions you ask for. Bunkhead justice and blanket parties will resolve most such situations.

      Painfully.

  8. She seems as though she is a nice person. I’m sure that she is smart and likeable. She apparently did a nice job while at Harvard.

    But she was promoted above her capabilities when she became Soliciter General. She had no appellate court experience before that. That is like appointing somebody to be an NFL quarterback based on the fact that they attended a prestigious school that studied NFL, and based on the fact that she knew a lot of NFL scouts. Watching films of games is not the same as playing in them. By all accounts that I have seen, she has done a less than mediocre job as soliciter general.

    This is just a case of somebody being promoted beyond their level of basic competence. Couple that with the fact that we know nothing about how she will actually rule (since she has no experience judging) on any issue, and I think you have a recipe for disaster. Sure, she might turn out to be good. But I don’t want to risk the next 40 years finding out…
